Regulamin sklepu internetowego (pl)

§1. GENERAL PROVISIONS

  1. MT-ARMS on-line shop available at the Internet address http://www.mt-arms.com (hereinafter referred to as: the "Shop") is run and owned by:  MT-ARMS, with its registered office at Poland,  e-mail: info@mt-arms.com, according to the entry in the Register of the Business Activities.

  2. The content of the page www.mt-arms.com shall be treated as an invitation to conclusion of the agreement.

 

§2. CONDITIONS OF PURCHASING

  1. The shop provides information about the products containing at least their description, price and availability of the goods in the warehouse of the Seller.

  2. The price is provided in Euro at the product on the Shop web-page at the time of purchasing by the Purchaser; the price is binding and final, includes VAT and does not include shipping costs.

  3. The Purchaser shall obtain information about the total value of the order after t has chosen method of delivery and payment. 

  4. Final confirmation of its order made by the Purchaser is an offer of conclusion of the sale agreement.

  5. The sale agreement is concluded as soon as the Purchaser purchases the goods.

 

§3.  DELIVERY OF GOODS

  1. Delivery of goods delivered to the Purchaser is as follows:

    1. Via DHL courier.

    2. Personally taken by the Purchaser or a person authorised by it at the registered office of the Seller.

  2. When ordering, the Purchaser shall be provided the exact cost of delivery of the goods to the address indicated by it.

  3. In the case of orders with delivery abroad, the Purchaser, upon receipt of confirmation, together with information on the total value of the order, including delivery costs, but excluding the cost of any additional customs duties, may choose one of two methods of payment:

    1. payment by bank transfer directly to the account of the Seller;

    2. electronic payment by bank transfer or by credit card using on-line payments supported.

After receipt of payment or information about its exact execution, the Seller shall provide the subject of the order via DHL to the address specified by the Purchaser.

4. The goods recipient - the Purchaser or a person authorized by it is obliged to check the status of the product packaging and the external status of the goods with special care.

5. Seller delivers goods to the following regions: USA, Canada, Australia, Europe.

 

§4. COMPLAINTS AND RETURNS

  1. The Seller shall not be liable for delay or non-delivery of the goods ordered by the Purchaser, arising from incorrect or inaccurate address.

  2. The Purchaser shall have the right, for any reason, to withdraw from the agreement within 14 (fourteen) days from the date of receipt of the consignment, in accordance with article 7 (1) of the act of 2nd March, 2000 on protection of certain consumer rights and liability for damage caused by a dangerous product (the Journal of Laws of 2008, No 45, item 271 as amended).

  3. The Purchaser shall have the right to return the purchased goods for any reason within 14 (fourteen) days from the date of receipt of the consignment. 

  4. Both withdrawal from the agreement referred to in § 5 (2) and return of the purchased good referred to § 5 (3) shall be possible only if the purchased good is intact and included in its original packaging.

  5. The amount paid for the purchased goods shall be returned to the Purchaser within 7 days from the date of receipt of the returned goods by the Seller. If payment is made by credit card, money refund shall be made directly to the card of the Purchaser.

  6. Claims for damage in transport or non-compliance with the order of the purchased goods shall be reported to Seller no later than within 3 days from the date of receipt of the consignment.

  7. All claims shall be responded within maximum of 14 working days from the date of receipt of a written claim by the Seller. In case of claims regarding the goods purchased in the shop, it shall be necessary to provide the defective goods with the proof of purchase, and the period of 14 working days to respond to the claim shall be calculated from the date of receipt of the claimed goods by the Seller. The cost of return of the goods shall be borne by the claimer, and the cost of shipping (after recognition of the merits of the claim) shall be borne by the Seller.  

  8. Both in the case of return of the goods due to withdraw from the agreement and recognised claim, money refund shall cover refund of cost and shipping amount paid the Purchaser when ordering.        

  9. If the Seller does not respond in relation to the good claimed by the Purchaser within 14 working days, calculated in accordance with the provisions of § 5 (7), it shall mean that the claim has been recognised by the Seller as reasonable.

 



§5.  PRIVACY POLICY

  1. The Purchaser shall agree to process its personal data provided by it in order to execute the orders made in on-line MT-ARMS Shop.

  2. Providing personal data is voluntary, but lack of consent to process the personal data in order to execute the order, prevents execution of the order provided by the Purchaser in on-line MT-ARMS Shop.

  3. The Seller shall process the personal data only to the extent necessary to conclusion, execution, change or withdraw from the sale agreement.

  4. The Seller shall undertake to protect the stored data of the Purchaser in such a way to prevent from access to them by third parties in accordance with the act of 29th August 1997 on protection of personal data (the consolidated text of the Journal of Laws No. 101 item 926 as amended).

  5. In the cases and under the conditions laid down in the Act of 29th August 1997 on protection of personal data (the consolidated text of the Journal of Laws, No 101, item 926 as amended), the Purchase shall have the right to request additions, updates, rectification of personal data, temporary or permanent suspension of processing the data or remove them if they are incomplete, outdate, incorrect or gathered in violation of the law or are no longer necessary to reach the objective, for which they were gathered, and also shall have the right to make a written request to cease processing of its personal data.

  6. The Seller shall not be liable for the effects of incorrect data provided by the Purchaser.

 

§6. FINAL PROVISIONS

  1. These Regulation shall enter into force on 1st January, 2014.

  2. The issues not covered by these regulations shall be governed by the provisions of the Polish law and, in particular, the Civil Code, the law on protection of consumer rights and liability for damage caused by dangerous products (the Journal of Laws No 22, of 2000, item 271) and the act on special conditions of consumer sales and change in the Civil Code (the Journal of Laws, No 141 of 2002 item 1176).

  3. The Seller reserves the right to make changes in the regulation of on-line MT-ARMS.COM Shop.
